Terms & Conditions

Last Updated: 14 April 2025  ·  Mutiara IP, Kota Kinabalu, Sabah, Malaysia

These Terms & Conditions govern the use of our website and the basis on which we undertake professional engagements. If you instruct us to act on your behalf, a separate letter of engagement will be provided that forms part of the contract between us. Please read these terms carefully.

1. About Us

Mutiara IP is an intellectual property practice based at Lot 2-3-11, Wisma Sabah, Jalan Tun Razak, 88000 Kota Kinabalu, Sabah, Malaysia. We offer advisory and filing services in trade marks, copyright, patents, and related IP matters under Malaysian law.

References to "we," "us," or "our" in these Terms refer to Mutiara IP. "You" refers to the individual or entity accessing our website or engaging our services.

2. Use of This Website

You may use our website for lawful purposes only. You agree not to:

  • Transmit any data that is unlawful, harmful, threatening, defamatory, or infringing.
  • Attempt to gain unauthorised access to any part of our website or its underlying systems.
  • Use automated tools to scrape, copy, or reproduce our content without written permission.
  • Upload or transmit viruses, malware, or other harmful code.

We reserve the right to suspend or terminate access to the website for any person found to be in breach of these conditions.

3. Information on This Website

The content published on this website is provided for general information purposes only. It does not constitute legal advice and should not be relied upon as such. IP law is jurisdiction-specific and fact-sensitive; any information here reflects the position under Malaysian law as understood at the time of publication and may not reflect subsequent legislative or regulatory changes.

We recommend that you seek specific legal advice for any matter of consequence. Nothing on this website creates a solicitor-client or attorney-client relationship between you and Mutiara IP.

4. Professional Engagements

Where you instruct us in a professional capacity, the following applies:

  • Letter of Engagement: All substantive matters proceed under a written letter of engagement that sets out scope, fees, and terms specific to your matter.
  • Fees: The indicative fees published on our website are starting points for uncomplicated matters. Actual fees may differ depending on complexity, urgency, and scope. We will provide a written estimate before commencing work.
  • Disbursements: Official fees payable to MyIPO, foreign registries, or couriers are charged in addition to our professional fees unless otherwise agreed in writing.
  • Billing: Invoices are payable within fourteen days of issue unless a different arrangement has been agreed. Late payment may result in work being placed on hold.
  • Termination: Either party may terminate an engagement by written notice. We will render a final account for work completed to the date of termination. You remain liable for disbursements already committed on your behalf.

5. Confidentiality

We treat all information provided to us in connection with a matter as confidential. We will not disclose client information to third parties except as required to carry out your instructions (for example, filing with MyIPO or instructing a foreign agent), or where required by law or professional regulation.

Information submitted through our website contact form is treated with discretion. However, email and web transmissions are not entirely secure. We are not liable for interception of communications in transit.

6. Intellectual Property Rights

All content on this website — including text, design elements, graphic marks, and structural layouts — is the intellectual property of Mutiara IP or its licensors. No part may be reproduced, distributed, or adapted without our prior written consent, except for personal non-commercial reference.

The Mutiara IP name and device mark are used as identifiers of our practice. Use of our name or marks in any commercial context without consent is prohibited.

7. Third-Party Links

Our website may include links to external resources such as MyIPO, WIPO, and Malaysian government portals. These links are provided for convenience only. We do not control the content of those sites and are not responsible for their accuracy, availability, or privacy practices. Links do not imply endorsement.

8. Limitation of Liability

To the extent permitted by applicable law, Mutiara IP excludes liability for:

  • Any loss or damage arising from reliance on general information published on this website rather than specific legal advice.
  • Interruption or unavailability of the website.
  • Any loss arising from third-party links or external services referenced on this website.

Nothing in these Terms limits our liability for fraud, gross negligence, or any matter that cannot lawfully be excluded under Malaysian law, including liability under the Legal Profession Act 1976 and applicable professional indemnity obligations.

9. Professional Complaints

We are committed to the quality of our work. If you are dissatisfied with any aspect of our service, we encourage you to raise the matter directly with us in writing so that we may address it. If the matter is not resolved to your satisfaction, you may refer it to the Bar Council of Malaysia in accordance with its established procedures.
