How long does trademark registration take in Malaysia?
Filing to registration typically takes 12 to 24 months at MyIPO, depending on whether objections are raised during examination or opposition is filed during the publication period. We monitor each matter at each procedural stage and report to you when action or a decision is required.
Does copyright in Malaysia require registration?
Under the Copyright Act 1987, protection arises automatically upon creation of an eligible work — no registration is required for subsistence of copyright. Voluntary notification with MyIPO is available and can assist in establishing priority evidence. Much of copyright practice in Malaysia therefore turns on clear contractual arrangements between authors, commissioners, and licensees rather than on registration procedure.
What is the process for filing a patent in Malaysia?
A patent application is filed at MyIPO and undergoes formal examination, substantive examination of novelty and inventive step, and publication. The process from filing to grant normally spans three to five years. For inventions with international scope, a PCT application can preserve priority in multiple territories while national examination proceeds in parallel. We work closely with inventors during claim drafting to ensure the scope of protection reflects the technical contribution accurately.
What information do I need to begin a trademark matter?
To conduct a proper availability search, we need the mark as it will be used (including any logo or device element), the goods or services it will cover, and the trading name or entity that will own the mark. We will then carry out a search and provide written advice before any filing is considered.
How are fees structured for IP work?
Our fees are stated clearly at the outset of each engagement and cover the scope of work agreed. Trademark matters are generally priced per class. Patent prosecution fees reflect the complexity of the technology and the anticipated scope of the specification. Disbursements to MyIPO are itemised separately. We do not apply hourly rates without prior agreement on scope, so you will not encounter unexpected cost escalation mid-matter.
